Can a Hospital Refuse to Release a Body Because of an Unpaid Bill?
Updated 6 October 2026
Hospital bills can become another source of distress after someone dies.
A family may be trying to arrange the funeral while also being told that the body cannot be released because medical charges remain unpaid.
Kenyan courts have taken the position that a deceased person’s body should not be used as security for a debt. Pasted text
Does the hospital bill still have to be paid?
Yes, the debt does not simply disappear because the patient has died.
The hospital may still pursue the outstanding amount through lawful debt-recovery processes.
The important distinction is that recovering a debt and withholding a deceased person’s body are not the same issue.
What should the family do first?
Ask the hospital to explain clearly why the body has not been released.
Where possible, request the position in writing.
Also obtain:
- a copy of the hospital bill
- a breakdown of outstanding charges
- any insurance correspondence
- mortuary charges being added
- written communication concerning release of the body
Keeping records can become important if the matter has to be escalated.
Check whether any cover applies
Before assuming the family must meet the full bill immediately, find out whether the deceased had:
- medical insurance
- employer medical benefits
- another applicable cover or benefit
Contact the insurer or employer promptly and ask what documentation is required.
Do not let the dispute continue indefinitely
If the body is being withheld solely because of the unpaid hospital bill, seek legal advice promptly. Pasted text
Long delays may create further stress and additional mortuary or storage costs.
Keep the funeral home informed
If a funeral date has already been discussed, tell the funeral director that release is delayed.
Do not confirm the mortuary collection time, procession or burial schedule until it is clear when the body can actually be released.
Remember
A family may still have a financial obligation to the hospital.
But the deceased person should not become the security through which that debt is enforced.
Handle the bill lawfully, and handle the deceased with dignity.
